1. Agreement to Terms

By downloading, installing, or using our command-line interface tool (form now onwards refered to as SurgeX), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you do not have permission to access or use our software. LMDLP LLC ("Company", "we", "us", or "our") is registered in New Mexico, United States.

2. Description of Service

SurgeX is a utility software designed to interact with the Solana blockchain. It is provided "as is" and "as available" without any warranties, express or implied. As of today, its main feature is volume making for decentralized exchanges.

3. No Data Collection

We do not collect, store, or process any personal data from users of SurgeX. All operations and data management occur locally on the user's system or directly on the Solana blockchain.

4. User Responsibilities

You are responsible for:

  • Maintaining the security of your private keys and wallet.
  • All activities that occur through your use of SurgeX.
  • Ensuring your system meets the technical requirements for running SurgeX.
  • Understanding the risks associated with cryptocurrency transactions.

By agreeing to the use of SurgeX, you will:

  • Be solely responsible for all the use of LMDLP products obtained.
  • Use our products only in accordance with these terms herein in the Terms of Service, relevant documents, and with any applicable laws and regliations.
  • Prevent any unauthorized access from our Products.
  • Use commercially reasonable efforts to prevent unauthorized access to or use of LMDLP products.
  • Not sublicense, lease, sell, resell, rent, loan, distribute, transfer or otherwise allow the use of SurgeX or any product / service on lmdlp.com for the benefit of third party.
  • Not intentionally reverse engineer, decompile, disassemble, or otherwise derive or determine or attempt to derive or determine the source code (or the underlying ideas, algorithms, structure or organization) of lmdlp.com nor any offered product.

5. Disclaimers and Risks

5.1 Cryptocurrency Risks

You acknowledge that:

  • Cryptocurrency values can be volatile.
  • Transactions on the blockchain are irreversible.
  • Smart contract interactions carry inherent risks.
  • Network fees and conditions are beyond our control.

5.2 Technical Disclaimers

We do not warrant that:

  • SurgeX will meet your specific requirements.
  • SurgeX will be uninterrupted, timely, secure, or error-free.
  • Any errors in the software will be corrected.

5.3 Automated Trading Disclaimers

You acknowledge and agree that:
  • Automated trading tools carry significant risks of financial loss.
  • Past performance does not guarantee future results.
  • Market conditions can change rapidly and unpredictably.
  • Technical issues, network latency, or blockchain congestion may affect tool performance.
  • We are not responsible for any trading losses incurred through the use of SurgeX.
  • The tool is not financial advice and should not be relied upon as such.
  • You should never trade more than you can afford to lose.

6. Intellectual Property

SurgeX, including its source code, documentation, and design, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use SurgeX.

7. Limitation of Liability

To the maximum extent permitted by law, LMDLP LLC shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, revenue, data, or cryptocurrency assets.
  • Any damages arising from your use or inability to use SurgeX.

We reserve the right to modify these terms at any time. Continued use of SurgeX following any changes constitutes acceptance of those changes.

9. Sanctions and export policy

You may not use lmdlp.com or purchase any of our products in or for the benefit of a country, organization, entity, or person embargoed or blocked by any government, including those on sanctions lists identified by the States Office of Foreign Asset Control. We do not claim, and we cannot guarantee that the SurgeX or any of our offered products is or will be appropriate or available for any location or jurisdiction, comply with the laws of any location or jurisdiction, or comply with laws governing export, import, or foreign use.
